Terms and Conditions of Business
These Terms and Conditions govern the contractual agreement between ADM Painters Decorators Glasgow (“the Company”), a painting, decorating, and sash window renovation company based in Glasgow, and the client (“the Client”) engaging the Company’s services.
1. Definitions
1.1 "Company" refers to ADM Painters Decorators Glasgow, including any of its employees, subcontractors, or agents.
1.2 "Client" refers to the individual or entity requesting the services.
1.3 "Services" refers to the painting, decorating, and sash window renovation work described in the quotation or agreement.
2. Scope of Work
2.1 The Company agrees to provide Services as specified in the quotation or contract agreed upon with the Client.
2.2 Any additional work requested beyond the original agreement will require a new quotation and separate approval.
3. Quotations
3.1 All quotations are valid for 30 days from the date of issue, unless otherwise specified.
3.2 Quotations are based on information provided by the Client. Any unforeseen issues (such as structural defects or hazardous materials) may result in additional charges.
3.3 The Company reserves the right to amend a quotation if there is a significant change in the scope or nature of the Services.
4. Booking and Scheduling
4.1 Upon acceptance of the quotation, a start date will be scheduled, subject to availability and weather conditions.
4.2 The Company will make reasonable efforts to adhere to agreed timelines but is not responsible for delays caused by factors beyond its control, such as weather, materials supply issues, or unforeseen conditions.
5. Payment Terms
5.1 A deposit of bewteen 20 to 50% is required upon acceptance of the quotation. This deposit is non-refundable except under exceptional circumstances at the Company’s discretion.
5.2 The remaining balance is payable upon completion of the Services, unless an alternative payment schedule is agreed in writing.
5.3 Payments should be made within 7 days of the invoice date. Late payments may incur interest at a rate of 2% per month until settled.
6. Client Responsibilities
6.1 The Client agrees to provide access to the premises and necessary utilities (such as electricity and water) during the project.
6.2 The Client should remove any personal belongings and furniture from the work area. The Company is not responsible for damage to items left in the workspace.
6.3 The Client is responsible for ensuring all work areas are safe and free from hazards prior to the start of Services.
7. Materials and Equipment
7.1 The Company will supply all necessary materials and equipment unless otherwise agreed in writing.
7.2 Any materials or equipment supplied by the Client must meet safety and quality standards. The Company is not liable for delays or issues caused by substandard Client-provided materials.
8. Warranty and Liability
8.1 The Company offers a 12-month warranty on workmanship from the date of completion, covering any defects resulting directly from the Services provided.
8.2 The Company is not responsible for issues arising from Client negligence, normal wear and tear, or misuse of materials.
8.3 Liability for any claim related to the Services shall be limited to the total fees paid by the Client. The Company shall not be liable for any indirect, special, or consequential damages.
9. Insurance
9.1 The Company holds public liability insurance, covering damage to property and injury arising from its Services.
9.2 The Client is advised to have suitable insurance coverage for personal property and liability as the Company is not liable for accidental damage caused by third parties or non-Company agents.
10. Cancellation Policy
10.1 The Client may cancel the Services at any time by providing written notice to the Company. Cancellations within 7 days of the scheduled start date will incur a fee equivalent to 20% of the quotation value.
10.2 The Company reserves the right to cancel Services at any time due to unforeseen circumstances, in which case any deposit paid will be refunded in full.
11. Health and Safety
11.1 The Company adheres to all relevant health and safety regulations. The Client must ensure that the work area complies with safety standards and notify the Company of any potential hazards.
11.2 The Company is not responsible for any injuries resulting from unsafe conditions that have not been disclosed by the Client.
12. Environmental Considerations
12.1 The Company aims to use environmentally friendly products where possible and will dispose of waste responsibly in accordance with local regulations.
12.2 The Client agrees to support the Company’s environmental efforts by allowing recycling of materials where applicable.
13. Confidentiality
13.1 The Company will maintain confidentiality of all Client information and will not disclose it to third parties without the Client's consent, except as required by law.
14. Complaints and Disputes
14.1 In the event of a complaint, the Client should contact the Company within 7 days of the issue arising. The Company will make every effort to resolve complaints amicably.
14.2 If a dispute cannot be resolved through communication, both parties agree to consider mediation before pursuing formal legal action.
15. Governing Law
15.1 These Terms and Conditions are governed by the laws of Scotland. Any disputes shall be subject to the jurisdiction of the Scottish courts.
16. Amendments
16.1 The Company reserves the right to amend these Terms and Conditions as necessary. The Client will be informed of any changes before they take effect.
17. Acceptance of Terms
17.1 By engaging the Company’s Services, the Client acknowledges acceptance of these Terms and Conditions in full.
